Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of Leap14, a digital fourteen-day behavioural program owned and operated by Averitt Technologies Private Limited ("Averitt", "we", "us", or "our"). By accessing the Leap14 website, taking the assessment, creating an account, making a purchase, or otherwise using the service, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use Leap14.

1. About us

1.1. Averitt Technologies Private Limited is a company incorporated under the Companies Act, 2013, bearing CIN U74999PB2022PTC056460 and GSTIN 03AAXCA3855D1ZM, with its registered office at H.No. 298, Ward No. 1, Near Royal Enfield Agency, Main Bazar, Morinda, Rupnagar, Punjab, India, 160055.

1.2. These Terms should be read together with our Privacy Policy and our Cancellation & Refund Policy, each of which forms part of your agreement with us.

2. The nature of the service

2.1. Leap14 is a self-paced, educational and behavioural support program intended to help adults reduce and quit smoking over a structured period of fourteen days.

2.2. Leap14 is not a medical service, medical device, or clinical treatment, and it is not a substitute for professional medical advice, diagnosis, or treatment.

2.3. You should consult a qualified medical practitioner before beginning the program, particularly if you have any existing medical condition, are pregnant or nursing, or are taking any medication. You should continue to seek the advice of your physician with any questions you may have regarding your health.

2.4. The program is delivered online through a web-based dashboard, together with reminder messages intended to be delivered over WhatsApp across Days 1 to 14.

3. Eligibility

3.1. You must be at least eighteen (18) years of age to use Leap14.

3.2. By using the service, you represent and warrant that you are eighteen years of age or older and that you have the legal capacity to enter into these Terms.

3.3. The service is intended for personal, non-commercial use by the registered user only.

4. Your account

4.1. To access the paid program, you must create an account and provide accurate, current, and complete information, including a valid email address and phone number.

4.2. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

4.3. You agree to notify us immediately of any unauthorised use of your account. We are not liable for any loss arising from your failure to keep your credentials secure.

4.4. Your account and your access to the program are personal to you and may not be shared, sold, transferred, or assigned to any other person, except in the case of a gift purchase made and redeemed in accordance with these Terms.

5. Access, coupons, and gift codes

5.1. Access to the program is granted either upon successful payment of the applicable fee or upon redemption of a valid access code or coupon issued by us.

5.2. Access codes and coupons are single-use unless expressly stated otherwise, are non-transferable except as part of a permitted gift purchase, and have no cash value.

5.3. Where you purchase the program as a gift, you will receive a redeemable code by email to share with your intended recipient, who must redeem it to begin their own program and who must themselves meet the eligibility requirements of these Terms.

5.4. Your access to the program continues for a period of one year from the date access is granted, after which it may expire.

6. Fees, payment, and taxes

6.1. The fees for Leap14 are displayed on the website in Indian Rupees (INR) and are inclusive of applicable Goods and Services Tax (GST) at the prevailing rate.

6.2. Payments are processed securely through our payment processor, Razorpay. By making a payment, you also agree to Razorpay's applicable terms.

6.3. Access to the paid program is granted promptly following successful payment. We reserve the right to revise our prices at any time, provided that any such revision will not affect access you have already purchased.

7. Refunds and cancellation

7.1. Refunds and cancellation are governed by our Cancellation & Refund Policy, which is incorporated into these Terms by reference.

7.2. In summary, and subject to that policy, we offer a full money-back guarantee if a refund is requested within three (3) days (seventy-two (72) hours) of purchase; purchases are non-refundable thereafter.

8. Acceptable use

8.1. You agree to use Leap14 only for its intended purpose and in compliance with all applicable laws.

8.2. You agree that you will not: (a) copy, reproduce, distribute, republish, or create derivative works from the program's content; (b) attempt to gain unauthorised access to the service, its systems, or other users' accounts; (c) interfere with, disrupt, or place an unreasonable load on the service or its infrastructure; (d) use any automated means to access or scrape the service; (e) resell or commercially exploit the service or its content; or (f) use the service in any manner that is unlawful, fraudulent, or harmful.

8.3. We reserve the right to suspend or terminate your access if you breach these Terms or if we reasonably suspect misuse.

9. Intellectual property

9.1. All content, materials, text, design, graphics, structure, methodology, and other intellectual property comprising Leap14 are owned by or licensed to Averitt Technologies Private Limited and are protected by applicable intellectual-property laws.

9.2. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the program for your own personal use during your access period. No other rights are granted to you.

10. No guarantee of results

10.1. Leap14 is designed to support your effort to reduce and quit smoking, but quitting smoking depends on many individual factors.

10.2. We do not warrant or guarantee any particular result, outcome, or success rate, and individual results will vary. Your use of the program is at your own discretion and responsibility.

11. Disclaimers

11.1. The service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, except as required by applicable law.

11.2. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components, or that any defects will be corrected.

12. Limitation of liability

12.1. To the maximum extent permitted by applicable law, Averitt Technologies Private Limited and its directors, officers, employees, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of, or inability to use, the service.

12.2. To the maximum extent permitted by applicable law, our total aggregate liability arising out of or in connection with the service or these Terms shall not exceed the amount actually paid by you to us for the program.

12.3. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

13. Indemnity

13.1. You agree to indemnify and hold harmless Averitt Technologies Private Limited and its directors, officers, and employees from and against any claims, damages, liabilities, costs, and expenses arising out of your breach of these Terms or your misuse of the service.

14. Suspension and termination

14.1. We may suspend or terminate your access to the service, with or without notice, if you breach these Terms, if required by law, or if we discontinue the service.

14.2. You may stop using the service at any time. Termination does not entitle you to any refund except as provided in our Cancellation & Refund Policy.

15. Changes to the service and to these Terms

15.1. We may modify, suspend, or discontinue any part of the service at any time.

15.2. We may update these Terms from time to time. Where changes are material, we will indicate this on this page with a revised "last updated" date. Your continued use of the service after any such change constitutes acceptance of the updated Terms.

16. Governing law and jurisdiction

16.1. These Terms are governed by and construed in accordance with the laws of India.

16.2. Subject to applicable law, the courts at Rupnagar, Punjab shall have jurisdiction over any disputes arising out of or in connection with these Terms or the service.
